McHenry Court System Overview

McHenry County is served by the 22nd Judicial Circuit of Illinois. This circuit exclusively covers McHenry County — one of the "collar" counties bordering the Chicago metropolitan area. Like all Illinois circuit courts, the McHenry court is a court of general jurisdiction: the Chief Judge assigns judges to criminal, civil, family, and other divisions as needed. The court is primarily funded by McHenry County.

What Types of Cases McHenry Courts Hear

The McHenry Circuit Court hears virtually all categories of cases allowed under Illinois law:

  • Criminal cases — felonies, misdemeanors, traffic violations, DUI
  • Civil lawsuits — general civil jurisdiction, small claims
  • Family law — divorce, custody, child support, protective orders
  • Probate — estate cases, guardianship, conservatorship
  • Juvenile cases — juvenile offenses, child protection, adoption
  • Traffic violations and infractions

District Court Cases in McHenry

Illinois does not have a separate "district court" at the state level — the Circuit Court is the court of general jurisdiction. In the 22nd Circuit, a judge hears felonies after charges are formally filed by the prosecutor or a grand jury returns an indictment. Civil cases with claims over $10,000 also fall into the general civil division.

Cases are assigned to judges by the Chief Judge of the circuit. Appeals from small claims or administrative hearings are also heard by the Circuit Court. After sentencing, a convicted person may file a post-conviction petition in the same court.

Magistrate Court Cases in McHenry

Illinois does not have separate magistrate courts. Instead, Associate Judges perform functions similar to magistrates in other states. They hear:

  • Misdemeanors and infractions
  • Preliminary hearings in felony cases
  • Civil cases with small claims
  • Small claims — up to $10,000
  • Traffic violations and DUI hearings

The jurisdictional limit for small claims in Illinois is $10,000. Associate Judges in McHenry often specialize in certain categories of cases — for example, one judge may primarily handle traffic cases, another family cases.

Family Law, Probate, and Juvenile Matters in McHenry

Family Law. Divorce, custody, child support, protective orders, and paternity are handled by the family division of the Circuit Court. Standardized forms for divorce and child support are available on the Illinois Supreme Court website. Certified copies of divorce decrees can be obtained from the Circuit Clerk or through the Illinois Department of Public Health.

Probate. Estate matters, appointment of guardians and conservators, and trust issues are handled by the probate division. A petition is filed by an interested party with the Circuit Clerk's office.

Juvenile Matters. Cases involving juvenile offenses and child protection (DCFS cases) are handled separately. Juvenile records are confidential under Illinois law, and access to them is strictly limited.

How Cases Move Through the McHenry Court System

  1. Case Initiation. A criminal case begins with a complaint or indictment; a civil case starts with the filing of a complaint or petition with the Circuit Clerk's office.
  2. Judge Assignment. The Chief Judge assigns the case to a specific judge based on the category.
  3. First Hearing. In criminal cases — arraignment (presentation of charges and determination of bail). In civil cases — a planning conference.
  4. Pre-Trial Phase. Parties exchange evidence (discovery), file motions. In criminal cases, plea negotiations may occur.
  5. Trial. A jury or judge renders a decision. Alternatives include settlement in civil cases or a guilty plea in criminal cases.
  6. Post-Judgment. Sentencing, filing an appeal with the Second District Appellate Court, or enforcement of the judgment.
